The rights related to Industrial Property are regulated by the Law no. 9,279 dated May 14, 1996. According to article 2 of this law, the protection of these rights is accomplished through the granting of patents for invention and utility model, registration of industrial designs, registration of trademarks, suppression of false geographical indications and suppression of unfair competition. Referring to the objective of this article, which is to provide information useful for the identification and prosecution of counterfeiting, the legal rules set out below are a summary of the law applicable to the seizure of illegal products, in judicial and administrative areas, emphasizing counterfeiting and some concepts and standards which typify other illicit behaviors linked to the trade and importation of counterfeit goods.
